Moolenaar’s bipartisan bill aims to protect America’s leadership in AI chips

U.S. Rep. John Moolenaar (R-MI) on Oct. 31 unveiled a bipartisan bill that would restrict the sales of advanced AI chips to companies from arms-embargoed countries if there is unmet demand from American companies.

“The GAIN AI Act will guarantee that no American company is ever put behind a foreign adversary buyer for advanced AI chips,” said Rep. Moolenaar, chairman of the House Select Committee on the Chinese Communist Party. “This is an America First Chip Policy in action that will build sustained American AI dominance.”

Specifically, the Guaranteeing Access and Innovation for National Artificial Intelligence (GAIN AI) Act of 2025, H.R. 5885, would require entities seeking a license to export advanced AI chips to countries of concern to certify that United States persons have priority in acquiring those chips, according to the text of the bill. 

Rep. Moolenaar sponsored H.R. 5885 alongside lead original cosponsor U.S. Rep. Raja Krishnamoorthi (D-IL), who is the ranking member of the Select Committee.

“Our legislation will ensure the demands of U.S. developers and small businesses for advanced AI chips are prioritized over the needs of our adversaries,” Rep. Krishnamoorthi said. “At a time when the most advanced chips are limited in supply, growing our economy and supporting American ingenuity should come before facilitating the CCP’s military modernization and human rights abuses.”
