Yakym bill would update current fuel tax on concrete boom pumps

The nation’s concrete pump industry would see tax parity under bipartisan legislation recently sponsored by U.S. Rep. Rudy Yakym (R-IN). 

The Concrete Pump Tax Fairness Act, H.R. 9258, which Rep. Yakym introduced on June 11 alongside lead original cosponsor U.S. Rep. Brad Schneider (D-IL), would replace the current fuel tax on mobile mounted concrete boom pumps with a mileage-based user fee.

“Concrete pump operators are the backbone of American construction. Many of the buildings you walk into were built by these hardworking men and women,” Rep. Yakym said. “This common-sense bill ensures that this vital construction equipment that builds America receives the same tax treatment as other mobile machinery.”

H.R. 9258 would replace the existing fuel tax with a mileage-based user fee — $0.05 per mile for vehicles under 60,000 pounds and $0.07 per mile for vehicles over 60,000 pounds — so operators are taxed on road use, not fuel consumption.

The bill also would call for all revenues to be deposited into the Highway Trust Fund to ensure concrete pump operators continue contributing their fair share to America’s infrastructure.

Additionally, H.R. 9258 would direct the U.S. Departments of Treasury and Transportation to build a streamlined compliance system that reduces administrative burden and protects the privacy of operators, according to a bill summary provided by Rep. Yakym’s staff.

“Concrete pumps shouldn’t face unfair double taxation — leading to stalled construction sites nationwide,” said Rep. Schneider. “As fuel and equipment costs rise, I’m glad to work with my colleague Rep. Yakym on a bipartisan, common-sense solution to right this wrong and ensure concrete pumping is treated fairly under the tax code like other pieces of mobile machinery in the construction industry.”

The American Concrete Pumping Association supports the measure, which has been referred for consideration to the U.S. House Ways and Means Committee.
